Terms of Use

These Terms govern your use of oopsclayco.com (the “Site”) and your purchases from Oops Clay Co (“we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, and our Product Disclaimer & Safety Information. If you do not agree, please do not use the Site.

1. Our products

Every piece is handmade, so small differences in color, shape, texture and finish from the photos are normal and are not defects. Product photos and descriptions are as accurate as we can make them. Please read our Product Disclaimer for materials, allergy, magnet and small-parts warnings before you buy.

2. Orders and pricing

Prices are shown in U.S. dollars. Your order is accepted when you receive our order confirmation. We may cancel and refund an order if an item is no longer available, a price was listed in error, or we suspect fraud.

3. Payment

Card payments are processed by Square on its own secure checkout page, under Square’s terms; we never receive your card number. Cash is accepted only for local pickup orders and is paid when we meet. You confirm that you are authorized to use the payment method you choose.

4. Pickup and shipping

For local pickup, we will email you to arrange a time and place. For shipped orders, we send your order with a carrier such as USPS, UPS or FedEx; delivery times are estimates, and the order is your responsibility once the carrier delivers it to the address you gave us. Please check your shipping address carefully.

5. Problems with an order

If your order arrives damaged, is missing something, or is not what you ordered, contact us at [email protected] as soon as you can, with your order number and a photo if possible, and we will work with you to make it right. Handmade variations and damage caused by wear or improper care are not defects; see the care section of our Product Disclaimer.

6. Adult section

Some products are in an adult section for people 18 and older. By confirming your age to enter it, you state that you are at least 18.

7. Using the Site

Please use the Site lawfully. Do not interfere with its security or operation, try to access accounts or data that are not yours, submit false information, or scrape the Site with automated tools.

8. Our designs and content

Our designs, photos, logo and text belong to Oops Clay Co and are protected by law. You may view and share links to our pages, but please do not copy or sell our designs or photos without our permission.

9. Service providers

The Site is built, hosted and managed for us by Firehouse 360 and relies on other providers for server hosting, network security, payments, email, spam protection and shipping. They are listed in the service providers section of our Privacy Policy. We are not responsible for their services or for interruptions they cause.

10. Disclaimer and limitation of liability

Except where the law does not allow it, the Site and our products are provided “as is,” without warranties of any kind, as described in our Product Disclaimer. To the fullest extent the law allows, Oops Clay Co is not liable for indirect, incidental or consequential damages, and our total liability for any claim about an order will not exceed the amount you paid for that order. Nothing in these Terms limits rights you have that cannot be limited by law.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules.

12. Changes to these Terms

We may update these Terms from time to time. We will post the new version here with a new effective date; it applies to orders placed after that date.
